RESUMO

Interdisciplinary by nature, this dissertationâs main purpose is to investigate the limits of criminal legality through the perspective of post-Wittgenstein pragmatic linguistics, especially when it comes to its relation to the principle of nullum crimen nulla poena sine lege certa, by discussing the ideas of clarity and certainty â first and foremost established after the French Revolutionâs legal-political model â in criminal accusatory texts. In addition to the Ordinary Language Philosophy, this work is based on the studies of Critical Discourse Analysis, remarkably those developed by Norman Fairclough, in a way that gives rise to a fundamental review of key concepts in general theory of crime, such as the formal semantic approach found in the field of the vagueness doctrine. In order to achieve this purpose, it is proposed a pragmatic redefinition of the utterances in the referred theory. Linguistic inaccuracies in criminal law â such as the ones that take place with normative elements, as well as potentially with other terms used in accusatory texts â lead to the formation of rhetoric judgments, which create a paradox in epistemology, undermining it, in case the notion of certainty within the text itself as the premise of criminal interpretation persists in the law community. This review of dogmatics and its theoretical stalemates pervades interpretativist precepts and it is based on the rupture with the idea of language as representation of the world and the movement towards language as a social praxis, that is, a linguistic use/activity. This dissertation does not intend to reduce law merely to text or to put to an end the guarantist function of the legality and the vagueness doctrine, but only to provide grounds for the reception of a criminal interpretation founded on the pragmatic restructuring of the dogmatic concepts.
