RESUMO

The main objective of this study is to analyze how slaves used the Rio Branco Law to plea for release from slavery in Pernambuco, mainly through actions of the Court of First Instance, between 1871 and 1888. Regardless of legal permission, there was already resistance to slavery in Brazil, but the legal system presents itself as an important source in understanding a bit more about the slave owner â slave relationship in the second half of the 19th century, since despite being a space pertaining to literate culture, it was used by people without judicial background and at times even brought them favorable results The Free Womb Law, which became known for freeing children born after September 28, 1871, contained several other mechanisms that could be used for liberation. Within these mechanisms, we find slaves and their families interfering in the sacred right of property, forcing the slave owners to free slaves not of their choosing. The dispute between liberty and property incited the spirits of the slave owners who were less inclined to free their captives, leading these slaves to achieve their liberty in the justice system on the brink of the signing of the Golden Law. In the last decades of slavery, it was no longer necessary to go through long defenses of the rights of freedom. With the new emancipative legislation, judges, lawyers and other members of society had legal support in favor of freedom. Although it did not save a considerable portion of the population from slavery, we can not neglect the importance of the law in propelling legal actions based on custom and questioning the right of property. And, more importantly, we had the opportunity to observe that slaves with families were not exceptions. The family was as present as was work, religion, amusement, punishment and the desire for liberty
