RESUMO

The present work aims to study the Restorative Justice as a method of social control, analyzed under the scope of the criminal law of the citizen, which is based on principles of human rights, contrary to the principles of criminal law of the enemy. Exposing exordial a retrospect of social control, are woven considerations about the forms of social control, emphasizing on the social control exercised through the criminal law. Study will be the criminal law and criminal law the enemy of the citizen, making a parallel approach to these different conceptions of criminal law enforcement, outlining issues such as terrorism, torture, victimology, etc. Analyzed these concepts of social control, we present the study of restorative justice, concepts, and objectives, a concept mapping exercise of justice as a manifestation of social control, inside the grounds of national criminal law. Then the experiments are presented in Spain and Brazil. Finally, the paper aims to provide an overview of restorative justice issue, a growing international socio-cultural movement that is based on a series of values, principles and protocols of operation, representing a new paradigm. That is, a more human way of operating in Criminal Justice, allowing meet on a priority needs of the victims and support the possibility of rehabilitation of offenders. This work became a reality through research in the libraries of the University Pablo de Olavide (Spain), University of Sevilla (Spain), the Pontifical Catholic University of São Paulo (Brazil) and the Brazilian Institute of Criminal Sciences (Brazil)
