A influÃncia do primitivo modelo jurisdicional Hebreu no direito moderno: a gÃnese da atividade jurisdicional

RESUMO

The jurisdictional function, while state attribute for the solution of litigations, occupies, in the juridical scenery the position of maxim greatness. Through it, the Judge State develops its constitutional role, pacifying conflicts and guaranteeing the social peace. In the current days, although, the Law assumes status of transnational actuation. Through the unification of States in economical blocks, it arises the jurisdictional activity in the role of leading vehicle of this fact, until then utopian. In a time of crisis of the institutions and of perceptible bankruptcy of the State as provider of the social welfare, to research the historical-social roots of the jurisdictional actuation is, before anything, to legitimate its actuation. The jurisdictional activity, as exclusive function of a official entity, precedes the modern State of Law. Since the Ancient Egyptian Empire, it is already known that the function of judging should be transferred from the ambit of the involved parts. Actually, that is the Hebrews, with a unique jurisdictional system, founded in solids moral and humanistic precepts, that will influence the whole juridical modern world through a slow laying down of the fundamental ideas of the Christianity, exposed in the Holy Bible. Several current principles in our procedural legislation are anchored in the biblical precepts. It is possible to identify in the Bible, specifically in the "mosaic legislation", all those that really inform the modern jurisdictional activity. From the hot sands of Palestine, a people, constituted by twelve tribes unified around a monotheist faith, has influenced legislators, preceptors, jurists and thinkers conveied by the Christian faith in the conception of a justice " in the molds of God "
