RESUMO

The understanding of the disability and of the disabled person has been changing throughout history, in a continuous process of changes of values and paradigms that involve and characterize the relation of the society with these people. In order to discuss the inclusion of the disabled person it is necessary to understand the concept and institutionalization of the disability, the evolution of social and human rights, as integral part of an individual subjective right turned out to be an important achievement for the insertion of the disabled people in the work market. Nevertheless the results brought out by this institutional device are still limited. From this perspective, this essay searches for explanations for the low rate of hiring of disabled people, having as reference the applications in the city of Belo Horizonte, Brazil, that are fundamented in empirical research of collecting and analysis of data in the public process of suing the companies for not observing the Lei 8.213/91(Disabled Act) of the circumscription of the 3rd Regional Procuracy of the Public Ministry of Labor. The research allowed us to observe that the law and its regulations have brought to the institutional environment unforeseen and maybe institutional dimorphism of the disability and the consequent hiring only to meet the legal requirements. This work also revealed that even in a highly institutionalized environment, the businesses looked for strategies that clearly attempted to discharacterize the Disabled Act, and this way legitimately disrespect it for the most different arguments, the companies appeal to the institutions themselves to set the allegations that their activities are not subordinated to legal application or are subject to professional regulation. They limit the offer of positions by raising the qualification level and by requiring previous experience to the applicants, and this way, disqualifying the bearer of any disability. The research also revealed that the companies do not prioritize the meeting of the quotas, this way, this work remarks that the low enforcement of the disabled act policy is due to institutional problems.
