RESUMO

This Master degree Lecture aims to present the Constitution as a System under an open Model concept, that is, the one that interacts with its Environment to exchange energy an information adapting itself to continuous alterations. For theorical basis it was used the System General Theory elaborated by the German biologist Ludwig Von Bertalanffy and further improved by the Chilean physician Humberto Maturana Romesin, as well as the German Sociologist Niklas Luhmann. Examining its presuppositions from inumerable Law doctriners, we have developed an analysis of the Constitution as an open system , that is, as a complex set of interdependent , coordinated and structured elements linked through a net of relations and constantly modified due to the society Historical Evolution and to the adding of new external elements or internal modification. These elements then become essentially dynamic so that the Constitution needs to process information from its adjusting itself to its necessities, ordering it through a doctrinal or jurisprudence interpretation of the Constitutional amendment or revision or even through the creation of new laws that might keep it lively and dynamic.
