RESUMO

The following work has been done to demonstrate the popular participation in public hearing in the Studies of Environmental Impact â SEI. Since the 70âs, itâs been noticed the interest and preocupation with environment, due to the advancement of technology as well as unplaned development. However, it really started when the 1988 Federal Constitution was promulgated. So far, the instrument of environmental policy was the federal law n. 6.938/81. Then, becoming na important instrument of administrative guardianship in the defense of environment. In the same why, popular participation, which main objective is to permit direct public manifestation of the citizen and communities that have been directy victimized by activities that have caused significant environmental damage in the studies of environmental impact - SEI, whem the public hearing happens. The public participation is still very incipient, due to the lack of broader public knowledge of the acts of public administration; of state interest in keeping the status. Our legislators, according to the Constitutional Text, have already taken care of the regulation(Law from 9.709/98), of the mechanisms of public participation, within the Federal Constitution of 1988 (art.14, I, II, III), essential to the consolidation of democracy in our country
