Controle jurisdicional do orçamento: planejamento orçamentário e diálogo constitucional no cumprimento dos direitos fundamentais a prestações fáticas.

RESUMO

The research aims the jurisdictional control of budget execution, which seeks to investigate its ability and form, based on the configuration of the constitutional budget norm and the need for dialogue between the constitutional public powers for the realization of constitutional rights to factual benefits. This is to discuss the responsibility transferred to the administrator for the management of res publica and its participation through budget law, aim to promote public policies, particularly in the context of administrative discretion. By the other hand, should consider the search for an alternative accountability of executive by judicial power, in a constitutional possibility for the effective control of the executive power, beyond the aspect of formal legality. Therefore, it is characterized the budget as a constitutional norm of a double aspect (principle and rule), which effects its implementation by conditional precedence rules in light of definitive reasons institutionalized in the Laws of the Public Budget. Furthermore, consequences lie in its application as a hermeneutic process of instrumental enforcement of public needs, identified in the 1998 Constitution of Brazil. The proposed solution is the constitutional possibility, theoretical and pragmatic, a judicial control of legality of the budget, subsidiary and related on the constitutional appropriations, concept developed in this paper. Once established a rule of precedence between public needs and taken the instrumental nature of the public budget, the Judiciary cannot refuse to dialogue with other powers, protecting the budget or overcome it in exceptional cases, through the objective custody of social rights (basic needs) always when needs are deprecated by constitutional or unconstitutional.
