RESUMO

The theme development is certainly present within the international communitys debates. Notwithstanding legal and political controversies on its definition, it is unanimously recognized that promoting and divulging it are the greatest challenges of our age. This paper is intended to analyze the evolution of the concept of development in the Unites Nations (UN) sphere. In fact, after the end of the Second World War, development was defined as the capacity of the states to generate wealth. In the 70s, development came to discussed as a right, a theory which was raised and supported by developing countries and rejected by developed countries. In the 90s the theme if development has been highlighted in several international conferences. In this context, the World Trade Organization (WTO), has been created. Its agreements provide special treatment to developing countries, term which is not defined by the UN or the WTO or by any other international organization. The absence of a definition for the term developing country as well as the various norms on the special treatment conferred to them, stresses the existing paradox. Notwithstanding the political content of the discussions that took place within the United Nations in relation to the right to development, the fact remains that it must to be promoted. This is the central hypothesis of this dissertation, which can be justified in solid legal and social basis
